we're starting out much warmer than average. temperatures today are going to reach into the upper 70s for the first day of the new year in some cities. we'll show you which beach cities are going to be the most comfortable for you and your family today. right now, it is 6:00. looking over san jose as people wake up on this first day of the new year, january 1st. this is "today in the bay." good morning. happy new year to you. i'm peggy bunker in for laura garcia-cannon. a 19-year-old woman has died after being hit by a truck. she was walking and carrying her three-month-old infant walking with her 17-year-old sister. all three were hit by the truck.

christie smith has the latest. did the driver stop? >> reporter: the driver did stop, is cooperating with fremont police. what he is saying is that, it was dark out here. it was before 10:00. we have a wide road, three turning lanes. he didn't see the trio when he was in the street. the 19-year-old woman was carrying her three-month-old baby boy along with the woman's 17-year-old sister. the baby thrown from the mom's arms and about 30 feet away into the street at paseo padre and mowry. a driver got out and helped and drove the child to the hospital. he is fighting for his life and is transferred to children's hospital in oakland for treatment. fremont police tried to do cpr on the mom on scene. she was taken to eden valley medical center where she died. the 17-year-old sister was treated as well.

the driver at the time was not drinking. a horrible, horrible way for one family to start the new year. reporting live in fremont, christie smith, today in the bay. the park boulevard on ramp to westbound 580 in oakland is back open at this hour. it was closed for a while so officials could investigate a deadly crash and clear up the roadway. which are told this white car flipped over trapping someone underneath it. two people were shot in oakland. the first happened at east 21st and 23rd. the victim was a woman riding in a vehicle. the driver took her to a local hospital where she died. later on, a teenage boy was shot on 104th avenue near walnut street. that shooting happened just before 9:30. the victim was rushed to the hospital in critical condition. oakland police say they don't know if he will survive. a setback for the family trying to keep their daughter on life support. a judge has denied a request to

force children's hospital oakland to surgically insert a breathing tube into jahi mcmath. a new york care facility has agreed to take her but she must the have a medical procedure before she can be moved. she has been on life support since october 9th. the court requires they keep her on a ventilator until january 7th. they are spending the first day of 2014 looking for a bank robber. they say this man walked into the union bank yesterday afternoon. he handed the teller a note demanding cash. he managed to get away before police arrived. it is still not clear how much money he was able to steal. the new covered california health insurance program is now in effect for 400,000 people state-wide. so many of them are wondering if they still have coverage. bob redell is live with his concern.

many people are wondering, do i have health insurance or not? >> many have not received the health insurance cards. generally, peggy, the answer to that question is going to be yes. you are going to be covered retro can retroactively to today, january 1st. you must pay your first premium by january 10th, a week from this friday. we spoke with the head of covered california. they tell us, if you haven't received the first bill, you will sometime this week. >> they need to pay their bill. we have ex tenntended that dead. you are going to get coverage effective january 1. you need to pay the bill. that's the next thing, the next hurdle to be crossed. what we're moving to is exciting. we are moving to getting people health care.

>> maybe you enrolled into your new program and are wondering what's taking the insurance company so long to send me that first bill. they waited several weeks to pass your information to your insurance companies. with regards to the insurance card, insurance companies are supposed to be sending that to you within ten days of receiving your first premium. you must pay them first to receive that card. if you are uninsured and have not yet enrolled in a health care plan, you have until the end of march, march 31st, to do so. otherwise, you will have to pay a penalty. reporting live, here in san jose, bob redell. pope francis started off the new year with mass at the vatican. the pope offered words of strength, courage to onlookers

at st. pete terse basilica. the catholic church dedicates january 1st to the promotion of world peace. the argentine-born pontiff urged catholics worldwide to follow an eye ten ner rather of faith that promotes a joyous gospel without borders. thousands of fireworks lit up the night's sky in san francisco to welcome in 2014. despite chilly temps, thousands still line the embarcadero waiting to see the 15-minute light show. while the rest of the year rung in the new year with their own impressive fire displace. one country attempted to land in the record book. stephanie stanton gives us a look at around the globe. >> midnight in new zealand brought fireworks over auckland's sky tower. in sydney harbor, more than 1 million people ushering in the new year with fireworks that lit up the city's iconic opera house and harbor bridge. it was temple bells in japan ringing the customary 108 times.

a solemn, dignified tradition bringing in the new year. 2014 was welcomed with a bang by the chinese. from the great wall to shanghai and if that wasn't spectacular enough, dubai's new year's celebration was one for the record books, literally. the world's tallest building center stage for an attempt at the world's largest display. at the same time, moscow rang in the new year in red square. in paris, tens of thousands celebrated at the eiffel tower. while in london, big ben rang out the old and rang in the new. >> in new york city, millions celebrating the famed ball drop and the coming new year. stephanie stanton, nbc news.

after any big party comes a big cleanup afterwards. you can see, they are almost finished. as soon as the ball dropped and the last few stragglers were pushed out, the crews began to remove 50 tons of confetti and crash. roughly 1 million people jammed into times square for the party. at 2:10, the stanford football team will go head to head with michigan state, at the 100th annual rose bowl. the cardinals are looking to make it back to back wins in pasadena. they took the title last year. for this showdown, odds makers are favoring stanford by a touchdown. a concord playground designed for children with disabilities will be featured. a concord resident will ride on the float with a 17-year-old boy

it sure is not going to feel like it. the bay area is in for a spectacular forecast with one exception. it is a big one. stick around. i'll sort you through all the details. getting you updated. a 19-year-old carrying her baby when she was hit by a truck in fremont has died. she was crossing the street with her 17-year-old sister when the three were hit by the truck. the child has severe injuries. the 17-year-old was treated for minor injuries. the driver said he didn't see the three and is cooperating with police. they do not think that alcohol was a factor. teams pulled a man in his 20s from the freezing hudson river overnight. investigators say the man drove off a parking lot and crashed through a steel barrier. he landed about 15-20 feet from the shore. they don't know why his car ended up in the hudson. las vegas held one of the biggest celebrations overnight with sold-out concerts and eight-minute long shows.

it was billed as the largest. former first lady, barbara bush, is in the hospital. she was admitted to the hospital with a respiratory issue. the bush family says the 88-year-old matriarch is in great condition. no word on when she will be released target is apologizing to its customers over gift cards. the retailer says an unknown number of gift cards were sold were not properly activated leaving customers at the registers with valueless cards. target says it will honor the affected cards. customers don't need a receipt. they were hit with a massive security breach that affected 40 million cardholders. honoring a bay area navy

s.e.a.l. a dangerous mission proved to be deadly for the navy s.e.a.l. the monte vista high school grad died while serving his country. they are making a film about it. >> this is the last picture we took of the family before he went off. >> reporter: jeff axleson will always have memories of his brother, navy s.e.a.l., matthew axleson, captured in personal photosdy played throughout his home. >> they found a half empty clip on a ridge somewhere. it had a.x. on the bottom and that's how they knew it was matt's. >> reporter: he was one of four navy s.e.a.l.s whose mission was to capture or kill ahmad shaw in 2005 in the mountains of afghanistan. the mission failed. axleson and two others s.e.a.l.s were killed in action. their story is called in a film called lone survivor. it was based on a book by the lone navy s.e.a.l. that survived. the trailer for the movie is seen here on youtube.

jeff axleson had already seen the film three times at special screenings. he admits it is difficult to watch a visual representation of how his brother died. >> it wasn't until the end. at the very end, they actually show video or pictures of the guys. that's when it kind of hits home. >> actor, ben foster, portrays matthew axleson in lone survivor. he met with the family to get a better understanding of the war hero and to capture his spirit. >> ben captured my brother as well as i could expect anyone to. >> axleson honored his courageous brother by naming his 2-year-old son, matthew, after him. one day, he plans to tell his son about his uncle. he chokes up thinking about it. >> i figured the moment sometimes captures the memories and at those times, you will know what to say. >> if anything, he will teach his son about the brotherhood, the values matthew axleson represented. >> despite life's challenges and tribulations and that, that brotherhood and that joy and that camaraderie that you have, just kind of takes you through life and will take you through

"lone survivor" will be released nationwide on january 10th. facebook ceo, mark zuckerberg, and husband wife, make the nation's largest philanthropic donation in 2013. the couple's donation to the silicon valley community foundation totaled close to $1 billion. making them the first under 30 philanthropists to top their annual ranking of publicly announced gifts. they donated the same amount of facebook stock, 18 million shares. they came in second, because the company's stock still had not risen above the ipo evaluation. >> a pair of bay area schools

are in london. both bands are expected to march by cameras in london just before 7:00 this morning if you are looking for them. new this morning, a baby born in the south bay appears to be the firstborn in the bay area in 2014. the baby girl was born two seconds past midnight at kaiser permanente. another baby born down the hall at 12:01. in san francisco, a baby boy and another boy born at california pacific medical center's california campus. he arrived at 12:01. four new little babies just after midnight. it is pretty cool. >> specially in such a big bay area.

maybe you have your babies home with you for today. you are looking for something to do. lots is happening across the bay area. you can hit the beach comfortable with your family today. temperatures are going to climb out of the 30s into the 70 ns some cities. the south bay is going to be nice and comfortable for today. 70 degrees in morgan hill. the peninsula will be a touch cooler here. not too bad. a mix of sun and clouds for today. a few high, thin clouds will move through. not expecting the low clouds to have a chance to develop this morning, september for up in the north bay. later on today, your temperatures are going to climb into the upper 60s. fremont, 65. the east shore, looking good. 64 for walnut creek and 70 degrees in the tri-valley. the further south you head, the warmer it gets. king city today, we could be hitting the upper 70s down there. unseasonably mild. that will continue as we head

the las vegas strip lit up with fireworks early this morning as the west coast welcomed the new year. not only was the stratosphere lit up by the fireworks were going at a number of other hotels. the treasure island hotel had its own display. there were lights behind the mini eiffel tower. one of the only nights of the year that the lights on the strip are dimmed so people can actually see the fireworks show. talk about an incredible catch. take a look at the bottom of your screen. a tv cameraman catches a 54-yard field goal. the ball came right at brian olson. he didn't flench and kept the camera steady at the same time. he is a photographer with kusa. give him a job on the football field. the nhl winter classic makes a return to michigan today. they have turned this from a

football field to an ice rink. you can see the transformation. here is the rink taking shape for today's game against the maple leafs and the red wings. work on the field started the day after christmas. it is expected to draw the largest crowd for an outdoor game in nhl history. they are keep able of seat mortgage than 105,000 fans. during today's winter classic, we will find out which hockey players will represent the u.s. the sharks are expected to have joe pavelski on the roster. women's hockey team will also be involved during the game. it is also possible we will see a brother and sister duo out there. the maple leaf's bill kessel could be among the players named while amanda is expected to be named to the women's team. that would be very cool. the winter classic will air on the nbc bay area. the maple leafs and the red

good morning. happy new year. i'm peggy bunker. a 19-year-old woman carrying her baby crossing paseo parkway has died. the baby was thrown from her arm. someone driving by took the baby to a nearby hospital. the child has severe injuries at this time. the 17-year-old was treated for minor injuries. the driver of the truck, a 64-year-old man, said he did not see the three walking along the road. he is cooperating with police. police at this time say no alcohol was involved. we are all waking up to a brand new year. while we welcome in 2014, we also need to get used to new laws from new rules for drivers

to new safety measures to protect the state's wildlife, here is a look at what's changed. >> a big change for k through 12. schools must now allow them to join the sports team or use the bathroom that correlates to their orientation. a student born a boy but identifies as a girl will be allowed to use the girl's bathroom and join a team such as the girl's bathroom. the new law for restaurant workers requires them to tax any tips added to the bill. that's usually the case when you have a party of six or more at a table. employers will no longer be able to fire an employee because they are victims of domestic abuse or sexual assault. they are required to change the work phone. new protection for bicyclists. they must give them three feet of clearance when cycling. if you can't, you have to slow down and let them pass. there is a grace period.

police will issue warnings now and start fining drivers in mid-september if there is no crash or a cyclist is not hurt. teens under 18 are completely banned from texting while driving. state has made it illegal to use voice recognition devices while teens are behind the wheel. law enforcement now has more power to prosecute hit an run drivers who kill or seriously hurt. under the old rules, prosecutors had just three years to prosecute someone with the crime. now, the statute of limitations has doubled to six years. drivers of hybrids that love to drive solo will get to do see for another five years. new protection for abducted children. law enforcement must now activate an amber alert if the kidnapper is a custodial parent or guardian that poses a serious risk to the child. the new law at protecting local wildlife is in effect. it was created after a local

warden shot and killed three mountain lion cubs instead of ro rolo kating them. for movie stars, tough new rules for the paparazzi. any photographer or paparazzi caught harassing children of celebrities or judges could face a fine for up to $10,000. u.c. campuses are going smoke-free. no use of tobacco on any of the ten u.c. campuses. that's berkeley and san francisco locally. it includes all tobacco products and ecigarettes. many are seeing a jump in pay. as of this morning, the minimum wage will jump up to $10.15. san francisco's minimum wage is also going up today.

workers will now be paid $10.74, up 19 cents from last year. san francisco has steadily increased its minimum wage based on the consumer price index every year since 2004. the rest of the state, their minimum wage goes up in july. today marks a change in the way we see things as well. as of midnight, it is illegal to move or import 60 and 40-watt incandescent bulbs. traditional 75 and 100-watt incandescent bulbs have already been phased out. other incandescent bulbs, such as those used in chandeliers are still legal to buy. san jose styrofoam band goes into effect today. most outlets are banned from

using styrofoam packaging. >> things are going so well with the current ban on plastic bags, they have doe sided necided not increase the price of paper bags. people will still pay 10 cents for all the bags they have at the store. colorado will be the first state to allow the legal sale of recreational marijuana. pot shops don't open up until later this morning. that did not stop people from lining up to be the first to purchase their newly legalized pot. the state has build some of the most complex regulations for weed. not everybody is a fan. >> i think it is going to be a huge disaster. there are just some things that there are more harm to society than there are benefits to it. >> now, pot shops will only sell

1 ounce to customers over 21 with a colorado i.d. out of state buyers are limited to a quarter ounce. 1 ounce before taxes will set you back $320. federal and state legislatures approved an increase. the increase applies to 5.4 million homes and 800,000 businesses in california. the increases will help pay for higher wholesale energy costs along with maintenance and upgrades. while the ball is dropping in new york city, snowflakes were falling in the chicago area. winter weather advisory did not stop people from heading out on the town for new year's eve. they got 3-6 inches headed there overnight. they went into action to deal with the snow. another system is forecast to roll in later today with up to 8

russian's president is in the city of volgograd. counter terrorism efforts killed 34 people. bombings one of the city's main train stations and another on a bus have raised security concerns as russia prepares to host the 2014 sochi winter olympics in february. so s sochi is located 400 miles from volgograd. the ship has been stuck in the ice since christmas. passengers must rely on rescue by helicopter. yesterday, they stamped out snow

>> happening now, crews are putting their finishing touches on this year's road parade floats. toni guinyard is live in pasadena where we are an hour away from the beginning of the 125th rose parade. an event people look forward to every year. how are you doing, toni? >> caller: i'm doing grand. i have met some really nice people out here. peggy, first of all, i want to show you down the street. this is colorado boulevard. you see all the people lining the street. some of them starting kamping out at noon yesterday. there are about six, seven deep all along this 5.5 parade route for the 125th rose parade. i also want to bring you over here to meet someone i met earlier this morning. a woman by the name of terry,

along the 5:5 mile route. the canine unit will be roaming through the crow. they just want everyone to have a lot of fun. i'm toni guinyard live from pasadena. this year's rose parade does not come without controversy. danny leclaire and his partner, audrey lute, plan to be the first to be married on a float. another woman has created a facebook page that says they should not be celebrating something that is illegal in 30 states. tell them no to a gay wedding on a float during a parade. send a message toheir sponsors as well. leclaire and lute say they don't understand why people are so upset. >> we are just getting married, having a wedding. >> we are expressing our love to each other. >> the couple has been together for 12 years. they will be exchanging their vows on top of a giant wedding

dark. i didn't see them out there. according to police, he hit the 19-year-old mom who was carrying her three-month-old baby boy. he is now fighting for his life. drivers drove that baby to the hospital nearby. the mom's 17-year-old sister was also hit. she suffered minor injuries. police did cpr and tried to help. they spoke with the driver, a 64-year-old man in a pup truck is cooperating. they don't think that drugs or alcohol were involved at all. reporting live, christie smith, "today in the bay." >> the park boulevard on ramp is back open this hour.

it was closed while officials investigating a deadly crash there. the first happened at east 21st and 23rd avenue. the vic testimony was a woman riding in a vehicle where she was shot. the driver took her to a local hospital where she later tied. a teenage boy was shot on 104th avenue near walnut street. the victim was rushed to the hospital in critical condition. oakland police do not know if the boy will survive. a setback for the family trying to keep their brain dead daughter on life support. a judge has denied a request to force the children's hospital to surgically insert a breathing tube. a new york facility has agreed

concerns. if you went to the sign-up and you are wondering if you are still covered, starting today, retroactively to today, january 1st, the first day of the new year. here is the hitch. you must pay your first preef yum by january 10th. that's a week from this friday. we spoke earlier with the head of covered california. if you don't receive the first bill, you should by sometime this week. they need to pay their bill. we have expended that deadline. the health plans say you pay by january 10th. you are going to get coverage effective january 1. you need to pay the bill. we are moving to getting people health care.

what's taking the insurance companies so long to send me that first bill. they waited several weeks to pass your information on along to your respective insurance company. they wanted to make sure the companies were ready before dumping all the data on them. with regards to the insurance card, insurance companies are supposed to send that to you within ten days of receiving your first premium. you must pay them first to receive that card. if you are uninsured, you have until march 31st to sign up or pay the penalty. a landmark change in the boy scouts of america policy takes place. the organization will now accept gay boy scouts, though not gay scout leaders. scouts cannot use their uniforms to promote gay political causes. the policy change went into effect thanks in part by a
